After ruling that Mrs. Rebecca Oine Julius Oamen’s demotion, removal from the payroll, and salary stoppage were illegal, unlawful, and unconstitutional, the National Industrial Court sitting in Abuja ordered her immediate reinstatement as a Director in the National Biosafety Management Agency (NBMA).
In Oamen v. Federal Civil Service Commission (FCSC), National Biosafety Management Agency, and another defendant, Justice of the Abuja Judicial Division handed down the verdict in Suit No. NICN/ABJ/37/2024.
According to the court’s order, the claimant must immediately be reinstated to her post as Director in the NBMA on CANRAISS Grade Level 15, along with all the perks that come with that position.
As a result of her promotion from Grade 14 to Grade 15, the court additionally mandated that the NBMA compensate Oamen for the income gap.
The court ordered the government agency to pay her a monthly salary differential of N201,809.08 beginning in February 2024 (when she started getting N154,105.67 based on Grade Level 14) and continuing until the judgment’s date.
Oamen was deposed and recalled from her position as Director of Administration and Finance, and the court ruled that her removal from the NBMA payroll, non-payment of her salary, entitlements, and emoluments beginning in December 2023, and all of the above were totally wrong.
Furthermore, the court granted the claimant’s request for a perpetual injunction prohibiting the defendants from carrying out the actions outlined in the letter from the Federal Civil Service Commission, which was dated December 12, 2023 and served as the foundation for the contested proceedings.
Oamen was also granted N300,000 in costs by the court and N500,000 against the third defendant, in addition to N500,000 against the Federal Civil Service Commission.
Since the claimant had established her case beyond a reasonable doubt, the court granted all of the requested reliefs.
It also found no validity in the third defendant’s counterclaim and dismissed it entirely.
